These Terms of Service ("Terms") govern your access to and use of Zaintee's website and AI content-generation service (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Zaintee is a workspace that turns plain-language descriptions into storyboards, generated images, and assembled video, including brand kit management and shared team workspaces. The Service relies on third-party AI generation partners; output quality, generation times, and model availability can vary. The Service is provided "as is" and "as available."
2. Accounts
- You must be at least 18 years old and able to form a binding contract.
- Registration requires a valid email address. Creation features are locked until you verify your email.
- You are responsible for keeping your credentials confidential and for all activity under your account.
- If you administer a team workspace, you are responsible for the conduct and content of the members you invite.
- Suspended accounts lose access to creation features for the duration of the suspension.
3. Credits and payments
Zaintee uses a prepaid credit model — you buy credits and spend them on generation operations. There are no subscriptions.
- Transparent pricing. Every operation displays its credit cost before you confirm it. You are charged the displayed price, in credits, on confirmation.
- No expiry. Credits do not expire while your account remains in good standing.
- Payments. Credit purchases are processed by third-party payment partners (mobile money, card, and other supported rails). We receive confirmations, not your payment credentials.
- Account credit. Credits may also be added to your account by administrators at our discretion (for example, promotions or support adjustments). Admin-granted credits carry no cash value and may be revoked on abuse.
- Price changes. We may change credit prices or per-operation costs prospectively. Credits already in your balance remain usable.
4. Your content
You retain ownership of everything you submit — prompts, brand kits, website URLs, uploaded images, and other inputs ("Inputs"). You grant us a limited license to process your Inputs — including transmitting them to our AI generation partners — solely to operate and provide the Service. You represent that you own or have the necessary rights, licenses, and consents for every Input you submit, including any brand assets, logos, or images of people.
5. Generated output
- You own what you generate. Subject to these Terms and the terms of our generation partners, the storyboards, images, and videos the Service produces for you are yours to use, including commercially.
- No exclusivity. Other users may receive similar or identical outputs. AI generation is not guaranteed to be unique.
- No originality warranty. We do not warrant that generated content is free of third-party rights or suitable for any particular purpose. Review output before publishing, especially for commercial campaigns.
6. Acceptable use
You must not use the Service to create, upload, or distribute:
- Unlawful content of any kind, in any jurisdiction that applies to you or us.
- Child sexual abuse material or any sexualized depiction of a minor. Zero tolerance — we report to authorities.
- Non-consensual depictions of real people — deepfakes, face swaps, voice clones, or any generated likeness of an identifiable person without their informed consent.
- Content that infringes intellectual property rights you do not hold.
- Fraudulent, deceptive, or misleading material, including fake endorsements and scam creatives.
- Malware, phishing, or spam content.
You must also not: probe, bypass, or abuse rate limits, credit accounting, or security controls; resell, wrap, or re-broker the Service without written agreement; scrape the Service or other users' content; or submit another person's image or biometric data without their consent.
7. Moderation and suspension
We may remove content, delete projects, suspend accounts, or revoke credits where we reasonably believe these Terms have been violated or where required by law. Administrative actions on your account are logged. If you believe an action was taken in error, email privacy@zaintee.com — we review appeals in good faith.
8. Availability and changes
We may modify, suspend, or discontinue any part of the Service. Generation capacity depends on third-party providers whose outages are outside our control. We will give reasonable advance notice of material changes to the Service or these Terms, by email or in-app notice; continued use after changes take effect constitutes acceptance.
9. Disclaimers and liability
- The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
- To the maximum extent permitted by law, Zaintee is not liable for indirect, incidental, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
- Our total aggregate liability arising from or related to the Service is limited to the amount you paid us for credits in the twelve months preceding the claim.
10. Termination
You may delete your account at any time by contacting us. We may suspend or terminate access for breach of these Terms or for legal or security reasons. On termination for cause, unused credits are forfeited; on voluntary deletion, unused credits lapse with the account. In neither case are credits refundable.
11. Governing law
These Terms and any dispute arising from them are governed by the laws of the Republic of Zambia, except where applicable law provides consumer rights that cannot be varied by contract.
